HOOVER® WARRANTY TERMS & CONDITIONS

TECHTRONIC INDUSTRIES AUSTRALIA PTY LTD AND TECHTRONIC INDUSTRIES N.Z. LIMITED  WARRANTY TERMS AND CONDITIONS FOR HOOVER PRODUCTS AND ACCESSORIES.

Techtronic Industries Australia Pty Ltd (ABN 98 002 277 509) and Techtronic Industries N.Z. Limited  (NZBN 9429039761347) provide the following manufacturer’s warranty in relation to any Hoover  product (and any accessory supplied with it) that has been purchased in Australia or New Zealand  from an authorised Hoover retailer or via Hoover (Australia) and Hoover (New Zealand) and when  the product is determined by Techtronic Industries Australia Pty Ltd or Techtronic Industries N.Z.  Limited to have a defect in its material or workmanship. 

The warranty period set out in these terms and conditions commences from the date of the sale  of the product by an authorised Hoover retailer or via Hoover Australia (www.hoover.com.au) and  Hoover New Zealand (www.hoover.co.nz) to the consumer. To claim under this manufacturer’s  warranty, proof of purchase and the date of purchase of the product must be evidenced by an  invoice/receipt. The warranty schedule for Hoover products is listed within Section 7 of this  document. 

This Hoover manufacturer’s warranty is only applicable to purchases from authorised Hoover  retailers in Australia and New Zealand or via Hoover Australia (www.hoover.com.au) and Hoover  New Zealand (www.hoover.co.nz). This warranty will not apply to Hoover products that are  purchased second hand and other non-authorised retailers. This Hoover product warranty does  not apply to any parallel imported product and does not apply to any Hoover products that are not  purchased from an authorised Hoover retailer. 

WHAT DOES MY HOOVER WARRANTY COVER?

1) THIS WARRANTY COVERS 

A. The product against faulty materials or workmanship. 

B. The replacements of parts and the repair labour used, for the remainder of the warranty period. 

C. If there is a fault or defect with the product within 30 days from purchase a consumer will be  eligible for a replacement product. A consumer can return the product to the place of purchase or  contact the Hoover Customer Service Team for return details if the product was purchased from the  Hoover website (www.hoover.com.au or www.hoover.co.nz) and the consumer will be eligible for a  replacement product. 

D. If there is a fault or defect with the product after 30 days, where that fault/problem is not a  major failure of the product, a consumer will be eligible for a product repair. A consumer can return  the product to the place of purchase or contact the Hoover Customer Service Team for return  details if the product was purchased from the Hoover website (www.hoover.com.au or  www.hoover.co.nz) for the product to be assessed and if found to have faulty materials or  workmanship then the consumer will be eligible for a product repair. 

2) THIS WARRANTY DOES NOT COVER 

A. If the product casing or cover is opened by a person other Hoover authorised service centre  personnel. 

B. If the product is not cleaned and maintained in accordance with the instructions for the correct  and regular cleaning set out in the manufacturer’s guidelines and product or user manuals. 

C. If the product has been exposed to water or liquid ingress as a result of the product not used in  accordance with the manufacturer’s instructions as provided with the product. 

D. Damage, defects, or faults caused as a result of repairs made or attempted by a person other  than Hoover authorised service centre personnel. 

E. Repairing or the carrying out of any work on the product by someone other than an authorised  Hoover service centre repair personnel. 

F. Wear and tear due to abnormal and/or excessive use. Parts such as carbon brushes, bearings,  seals, o rings, brush bars and similar parts and items must be regularly inspected so that the wear  and tear on such parts do not lead to failure of the product. For optimum performance the product  should be inspected regularly by a Hoover authorised service centre. 

G. Abuse, neglect, misuse, the subject of an accident, being dropped, crushed, impacted with  any hard surface, exposed to extreme heat (including fire) or cold, improper maintenance, and  continued use after partial failure. 

H. Acts of God, vermin or foreign matter entering e.g. dirt and moisture.  

I. If the product has been modified, incorrectly adjusted or operated, the subject of incorrect  electrical supply or inconsistent supply, or used with inappropriate accessories. 

J. If the product is tampered with any way or if the damage has been caused by any event of force  majeure. 

K. If the product has not been used or maintained in accordance with the manufacturer’s  instructions as provided with the product. 

L. If the product’s serial number, as applied by the manufacturer, has been altered or removed from  the product. 

M. The repair or replacement of any consumables (including but not limited to filters, brush bars,  cleaning solutions and other similar parts and items) relating to the product. 

N. The product is purchased from a retailer that is not authorised by us to sell Hoover products or  the product is purchased outside of Australia or New Zealand. 

3) IMPORTANT INFORMATION – CONSUMER GUARANTEES FOR GOODS AND SERVICES

This warranty is in addition to all other rights and remedies you have under the Australian  Competition and Consumer Act 2010 (Cth) and the New Zealand Consumer Guarantee Act 1993 and  any other laws in relation to the products. 

For products sold in Australia, this warranty is subject to the Competition and Consumer Act 2010.  For products sold in New Zealand, this warranty is subject to the Consumer Guarantees Act 1993 

Our goods and services come with guarantees that cannot be excluded under the Australian  Consumer Law and the New Zealand Consumer Law. For major failures with the service, you are  entitled: 

1. To cancel your service contract with us; and 

2. To a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods.  

If a failure with the goods or a service does not amount to a major failure, you are entitled to have  the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the  goods and to cancel the contract for the service and obtain a refund of any unused portion.  

You are also entitled to be compensated for any other reasonably foreseeable loss or damage from  a failure in the goods or service. 

4) HOW DO YOU MAKE A CLAIM UNDER WARRANTY 

In the event that your product may be faulty, please visit the place of purchase or contact the  Hoover Customer Service Team for return details if the product was purchased from the Hoover  website (www.hoover.com.au or www.hoover.co.nz) so that a qualified technician can assess if the  product qualifies for warranty repairs due to faulty materials or workmanship and diagnose any  issues and make warranty repairs, if necessary. 

AUSTRALIA 

For service in Australia, the consumer should contact the Australian Hoover Customer Service Team  on 1300 698 130 to obtain the nearest authorised service centre. 

NEW ZEALAND 

For service in New Zealand, the consumer should contact the New Zealand Hoover Customer  Service Team on 0800 126 688 to obtain the nearest authorised service centre.

RETURN TO PLACE OF PURCHASE 

If you return the product to the place of purchase to claim under this warranty, the retailer can  dispatch your product to the nearest Hoover authorised service centre without cost to you. 

5) HAZARDOUS MATERIAL: 

Consumers are responsible for the care and cleaning of their product. 

Products that are not clean and contain or have come into contact with a hazardous substance (in  our opinion) cannot be returned to us and will not be accepted or will be returned to the consumer. 

A product that has come into contact with a hazardous substance is an Occupational/Work Health  and Safety risk. 

Any product being sent to us must be cleaned to a safe and satisfactory level. Where a product  contains an unknown particulate/s (such as asbestos, silica dust, bio waste and other similar  hazardous material) you must provide evidence showing the product has been professionally  cleaned. 

Techtronic Industries Australia Pty Ltd and Techtronic Industries N.Z Limited reserve the right to  refuse the return of any product which has been exposed to a hazardous substance (in our opinion)  such as asbestos. 

6) EXCLUSION OF IMPLIED WARRANTIES: 

To the full extent permitted by law, all warranties, conditions and other terms express or implied  by statute, custom or common law are excluded. Nothing contained in these terms and conditions  excludes or restricts any consumer guarantee, warranty, condition, right or remedy under any  statute (including the Australian Competition and Consumer Act 2010 and the New Zealand  Consumer Guarantees Act 1993) which cannot be excluded, provided that, to the extent that the  statute permits Techtronic Industries Australia Pty Ltd and Techtronic Industries N.Z. Limited are  entitled to limit its liability for a breach of a guarantee, condition or a warranty implied by that  statute. 

7) SCHEDULE TO WARRANTY TERMS AND CONDITIONS FOR HOOVER PRODUCTS AND ACCESSORIES 

The schedule outlining the warranty period is set out below and is applicable as of the 1st of  October 2023 for all purchases from authorised Hoover retailers:
